Terms of Service
By accessing this website or engaging A.S.H Studio ('Provider') for software engineering, digital architecture, or consulting services, you ('Client') agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and the Provider.
1. Scope of Services & Estimates
The Provider delivers custom digital solutions. All estimates generated via the website calculator are preliminary and for informational purposes only. The final scope of work, technical specifications, and delivery timelines are defined exclusively in a signed Service Agreement or a finalized Invoice. Any modifications to the scope requested after project commencement shall be subject to additional fees.
2. Payment & Financial Obligations
All fees are quoted in the currency specified in the invoice. Taxes and statutory levies are applied in accordance with the regulations of the Provider's jurisdiction. Work commences only upon receipt of a non-refundable deposit. Final project delivery and the transfer of intellectual property rights are contingent upon 100% settlement of all outstanding invoices. Late payments shall incur interest at the maximum statutory rate.
3. Intellectual Property Rights
Full ownership of the custom code, designs, and assets created specifically for the Client is transferred only upon receipt of full payment. The Provider retains the right to use generic code libraries, pre-existing frameworks, and snippets in other projects. Unless otherwise agreed in writing, the Provider reserves the right to showcase the completed project in its professional portfolio.
4. Limitation of Liability & Third Parties
The Provider shall not be liable for any indirect, incidental, or consequential damages, including loss of profit or data. Our total liability is strictly limited to the amount paid for the specific service. The Provider is not responsible for disruptions caused by third-party platforms, including but not limited to Telegram API changes, hosting provider outages, or search engine algorithm updates.
5. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the Provider is incorporated. Any disputes arising from these Terms shall be resolved exclusively in the competent courts of the Provider's place of business.
